GTC

Scope of application

The physical and digital gift card of Coiffure Claus and Carla, in particular Mohn’s Haarpflege AG, is a debit card on which a credit balance is held by the customer vis-à-vis Mohn’s Haarpflege AG. The customer can use the credit on the gift card to purchase goods and/or services offered by Coiffure Claus & Carla in the branches of Coiffure Claus & Carla within the framework of the following General Terms and Conditions (GTC). These terms and conditions serve to clearly regulate the mutual relationship between the customer and Mohn’s Haarpflege AG.

By purchasing a gift card, the customer agrees to these terms and conditions and undertakes to comply with them.

 

Online ordering and payment process for gift cards

1. Gift cards with different values of CHF 20, CHF 50 or CHF 100 can be purchased in all branches of Coiffure Claus & Carla as well as online.
   
   
2. Gift cards may only be purchased online by credit card. The following means of payment are accepted: VISA, MasterCard, Diners, Twint. The gift cards will be sent to the delivery address (e-mail address for the digital gift card) in Switzerland provided when ordering online. As a rule, the physical gift cards ordered will be sent by post within 7 working days of confirmation of dispatch. The shipping costs amount to CHF 3.50.
   
   
3. The customer bears the risk of postal delivery for the physical gift card. It is the customer’s responsibility to check the card immediately upon delivery and to report any defects within 3 working days of receipt by e-mail to geschenkkarte@claus-carla.ch to object.
   
   
4. The customer bears the risk of electronic delivery for the digital gift cards. The customer checks the current voucher balance on the claus-carla.ch website using the code issued in the e-mail. It is the customer’s responsibility to check the electronically generated gift card immediately upon receipt by e-mail and to report any defects immediately within one working day by e-mail to geschenkkarte@claus-carla.ch .
   
   
5. The physical and digital cards are loaded and activated once payment has been received.
   
   
6. Once activated, the card can be used to pay for the goods and services offered by Mohn’s Haarpflege AG in all branches of Coiffure Claus & Carla.
   
   
7. The physical card can be recharged at any time in the branches of Coiffure Claus & Carla against payment on site (cash or debit/credit card).
   
   
8. No interest is paid on the credit balance.
   
   
9. No Coop Superpoints are credited when a gift card is purchased. The customer only receives Coop Superpoints when paying with the gift card in a Coiffure Claus & Carla branch on presentation of the Coop Supercard.
   
   
10. The gift cards are impersonal and therefore transferable.

     

Redeeming the credit

1. The credit on the gift card can be used in all branches of Coiffure Claus & Carla to pay for the goods and services offered by Mohn’s Haarpflege AG. Exceptions are cards with the imprint “exclusive” (i.e. excluding) sales product(s); for these, the gift cards can only be redeemed for services from Coiffure Claus & Carla. The gift card cannot be used for online purchases.
   
   
2. a) If the card balance exceeds the value of the goods/services, the remaining balance remains on the card.

   b) If the card balance is lower than the value of the goods/services, the remaining amount must be paid directly on site in cash or by debit/credit card.

3. The remaining balance can be checked at any time at the checkout or via the claus-carla.ch website .
   
   
4. When paying with gift cards, only the actual costs of the goods/services can be paid.
   
   
5. Gift cards are not subject to an expiration date. Blocked cards will be rejected by the card readers in the stores. Holders of blocked cards can send an e-mail with the card number to geschenkkarte@claus-carla.ch.
   
   
6. Any remaining balance will not be paid out.

 

Disclaimer

Mohn’s Haarpflege AG accepts no liability for loss, theft or damage to the gift card. The gift card must therefore be treated as cash. Coiffure Claus & Carla accepts no liability in the event of loss, theft or damage to the gift card. Lost gift cards will neither be blocked nor replaced. Any remaining balance will not be paid out. The exclusion of liability does not apply in the event of unlawful intent and/or gross negligence.

Right of withdrawal

1. The customer may cancel the purchase contract within 7 days without giving reasons and without penalty. The period for exercising this right begins on the day on which the customer purchased this gift card.
   
   
2. Gift cards that have been used or damaged by the customer are excluded from the right of withdrawal. Should Coiffure Claus & Carla discover upon return that a gift card has already been used and/or is no longer in a saleable condition, Coiffure Claus & Carla may refuse to refund the purchase price or cancel the order and insist on payment of the purchase price.
   
   
3. The customer shall bear the costs of transportation for returns.
   
   

 

Data security and data protection

All data transmitted to Mohn’s Haarpflege AG is treated confidentially and is subject to the regulations of the Swiss Data Protection Act. Mohn’s Haarpflege AG uses the personal buyer data only for order processing. The e-mail address and personal data are treated confidentially and are not passed on to third parties.

 

Changes and additions

Mohn’s Haarpflege AG reserves the right to change the gift card ordering process and these GTC at any time. The currently valid version of the GTC will be published on the Coiffure Claus & Carla website at https://claus-carla.ch/privacy-policy/. In the event of any inconsistencies between the German, French and English texts of the GTC, the German text shall prevail.

 

Further provisions

If payment by gift card is not possible due to a technical fault, Mohn’s Haarpflege AG reserves the right to refuse payment by card in individual cases.

1. Should individual provisions of these GTC prove to be invalid or unenforceable or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. In the event of the invalidity or nullity of a provision, it shall be replaced by a valid provision that comes closest to the economic purpose of the invalid or null and void provision.
   
   
2. The personal terms used apply to both male and female persons.
   
   
3. Swiss law applies and the place of jurisdiction is Baar/ZG.
